Mossgrove - Distribution of Harvest Proceeds Information
Australian Taxation Office
In a recent discussion with officers of the Product Ruling section of the Australian Taxation Office, the officers confirmed that the change of responsible entity and the additional fees were not considered material changes and did not give grounds for removing the non commercial loss exercise of discretion. The ATO is satisfied that the plantations are being maintained.
Trust Maintenance Funds
On 1 October 2010, McKerracher J of the Federal Court ordered that the liquidator of Great Southern was entitled to the Trust Maintenance Funds. The reasons for decision are able to be read on the Federal Court’s website.
Primary Securities sought leave to appeal on the basis that this money is scheme property and therefore is subject to a trust in favour of the investors. On 23rd December 2010 the appeal was denied.
Fire Insurance
Primary Securities Ltd has taken out insurance with effect from 1st October 2011.
